From my take on the case, plea deal or not, Miles would face some punishment since it is a felony, therefore he cannot just settle with wife/girlfriend and try to remove himself from the situation.
Not sure if I read that here but even if he settles with his wife, the DA can still pursue the criminal charges right?
That is correct from what I gather.
Yes. You can’t settle non-civil charges. Now if all the people involved change their story or are “unsure” the case can fall apart
And that, to echo @QC_Thundercats’ point, is why he pleaded not guilty. The 11 years, 8 months will be if he’s found guilty of all charges and receives a maximum sentence for all of them.
I kind of want to just leave this whole case alone now. Discussing basketball and roster ramifications when he has allegedly/almost certainly abused/beaten his wife in front of their child on multiple occasions makes anything else … irrelevant. It felt wrong, even vile, referencing him in the off season thread.

Wild @ss speculation! On sports/entertainment okay but about the criminal justice system w real victims - careless at best. (We all saw the pictures so there are victims!)
You can’t guess or figure out what will happen. Things look bad and they are bad. Attacking a prosecutor on this board may make you feel better but it doesn’t do jack other than spread reckless conspiracy theories. All you can do is watch and let the justice system play out.
Some of you need to get used to the idea that Miles may have f-ed himself, the team, Jordan, the NBA, the city, the state, his family, the organization, the fans, those women and the kids. If he did then everybody needs to move on, focus on the future of the organization and pray that everyone gets the help that they need.

Civil and criminal cases are two completely different realms.
Civil cases are between two parties. One party sues the other for any wrongs done to them, in order to compensate them and make them whole. So basically if Miles’ wife seeks monetary damages to pay for hospital bills, therapies for her and kids, lost wages or opportunities during recovery, emotional trauma, and any other amount the judge deems just to make her whole.
But this is also her choice to pursue, and if she decides to drop it, there will be no case to go forward in the civil arena.
Criminal deals with the state (CA in this instance) against the accused. The state represents the people of the state, and their rights to make sure laws are followed and crimes go punished in a civil society. Each state can choose to pursue criminal charges against anyone, regardless of victim participation. It does get harder if a victim does not participate and there is no other evidence. But because there already is a lot of evidence available, plus any further investigations the prosecutors and police are empowered to pursue, they can choose to go forward with trial regardless of what Miles’ wife chooses to do.
Now political ramifications do sometimes take a part on criminal decisions by the D.A., which is why the rich and powerful can get away with things that regular schmucks can’t. But that’s a different story for another day.
I’ll believe it when I see it. The history of athletes and celebrities facing real punishment for awful things like this isn’t good.

If Golden State’s termination of Sprewell’s contract was not upheld, I’m not sure the good moral character clause has any teeth.
First has the contract been signed by either side? Second it has to be a way to not have to pay it. The NBA should be on the owners side about this kind of thing. HOW much was our offer and are we stuck with dead money?

Contract law is more my speed! Yes these causes should be widespread in general and Miles specifically should have 50 pages of those clauses in his contract! Sure the union would object but I don’t see any of those turkeys stepping up to take the risk of paying a man-child like Miles 25 million a year.
With all of that said, as usual, this is just wild @ss speculation especially when you don’t have the actual contract in front of you. Who knows what was in and what wasn’t in Sprewell’s contract? Speaking of Sprewell you can be as dumb as they come and still make in this great nation!
